At Buy Buy Cart, our objective is to facilitate smooth, efficient, and transparent delivery of Fast-Moving Consumer Goods (FMCG) through a technology-enabled marketplace and supply-chain facilitation platform. Buy Buy Cart connects customers with independent stores, sellers, distributors, and fulfillment partners and enables order placement, logistics coordination, and delivery facilitation.

This Shipping and Delivery Policy sets out the detailed terms governing order processing, dispatch, delivery, and allocation of responsibilities. The policy is framed in line with industry best practices followed by leading FMCG and quick-commerce platforms and is suitably adapted to Buy Buy Cart’s operational model.

By placing an order through Buy Buy Cart by any mode including website, mobile application, direct sales channels, or business communications, the customer expressly agrees to be bound by this Shipping and Delivery Policy.

1. Serviceable Areas

Buy Buy Cart facilitates delivery services across select cities, regions, and pin codes within India. The availability of delivery services is determined by multiple operational factors, including but not limited to the presence of participating stores or sellers, warehouse coverage, distributor reach, logistical feasibility, infrastructure availability, and compliance with applicable laws and regulations.

Serviceability of a particular location is dynamically determined at the time of order placement. Buy Buy Cart reserves the absolute right to add, remove, suspend, restrict, or modify serviceable locations without prior notice due to operational constraints, regulatory changes, or business considerations.

• Nature of Platform and Marketplace Role

Buy Buy Cart operates strictly as a marketplace facilitator and logistics coordination platform. It does not ordinarily own, manufacture, store, or directly sell the products listed on the platform unless explicitly stated otherwise.

Independent stores, sellers, distributors, or vendors listed on Buy Buy Cart are solely responsible for listing products, maintaining inventory, fulfilling orders, issuing invoices, and ensuring statutory and regulatory compliance. Buy Buy Cart’s role is limited to enabling discovery, order placement, payment facilitation (where applicable), and logistics coordination.

• Order Placement and Acceptance

All orders placed on Buy Buy Cart are offers by the customer to purchase products from the concerned store or seller. Acceptance of an order occurs only upon confirmation by the respective store or seller after verifying stock availability, pricing, delivery feasibility, and payment confirmation.

Buy Buy Cart reserves the right, on its own behalf or on behalf of the store, to cancel or modify an order in case of incorrect pricing, stock mismatch, suspected fraud, bulk quantity issues, or operational limitations. Such cancellation shall not entitle the customer to claim damages or compensation beyond refund, if applicable.

• Order Processing

Once an order is accepted, it enters the processing stage wherein the concerned store or warehouse undertakes picking, packing, and preparation for dispatch. Processing timelines may vary depending upon product category, order size, store capacity, and logistical arrangements.

Buy Buy Cart does not guarantee processing within a fixed timeframe and shall not be liable for delays attributable to store-level constraints, manpower shortages, technical issues, or regulatory inspections.

• Delivery Timelines

Estimated delivery timelines displayed or communicated at the time of order placement are approximate and indicative in nature. Actual delivery may vary due to distance from the fulfillment location, traffic conditions, weather disturbances, law-and-order situations, festive rush, or unforeseen operational issues.

While Buy Buy Cart endeavours to ensure prompt deliveries, especially for essential FMCG items, delays do not give rise to any right to compensation, penalty, or damages against Buy Buy Cart or the store.

• Shipping and Delivery Charges

Delivery charges, convenience fees, or handling charges, if applicable, shall be clearly disclosed prior to order confirmation. Charges may be calculated based on order value, weight, volume, delivery distance, or promotional parameters.

Any waiver, discount, or free delivery offer is purely discretionary and may be withdrawn or modified at any time without prior notice.

• Mode of Delivery

Delivery of orders may be carried out through store-employed delivery personnel, authorized logistics partners, third-party courier companies, distributors, or local last-mile agents. The selection of delivery mode is made by Buy Buy Cart or the concerned store based on efficiency, cost, and availability.

Customers do not have the right to choose or insist upon a particular delivery partner, vehicle type, or delivery method.

• Dispatch Confirmation and Tracking

Dispatch confirmation may be provided through electronic communication such as SMS, email, or app notification. Tracking facilities, where provided, are dependent on third-party systems and are offered on a best-effort basis.

Buy Buy Cart shall not be liable for any inaccuracies, delays, or technical failures in tracking information provided by logistics partners.

• Delivery Attempt and Customer Obligations

Delivery attempts shall be made at the address provided by the customer. Customers must ensure accuracy of address details, availability at the location, and safe access for delivery personnel.

In case of failed delivery due to incorrect address, unavailability, refusal, or restricted access, Buy Buy Cart and/or the store may cancel the order or reattempt delivery with additional charges.

1. Proof of Delivery

Delivery shall be deemed completed upon successful handover of goods to the customer, authorized representative, security personnel, or reception desk, as evidenced by OTP confirmation, signature, delivery logs, or system records.

Such proof shall be final and binding for all purposes.

1. Inspection, Acceptance, and Reporting

Customers are expected to inspect goods at the time of delivery for visible defects, missing items, or incorrect products. Acceptance of delivery signifies acknowledgment that goods were received in satisfactory condition.

Complaints raised after delivery acceptance, especially for FMCG or perishable goods, may not be entertained unless mandated by law.

1. Responsibility of Goods and Store Liability

The entire responsibility for the goods supplied including quality, quantity, packaging, labeling, expiry, safety, statutory compliance, and invoicing rests solely with the specific store, seller, distributor, or vendor fulfilling the order.

Buy Buy Cart:

1. Does not assume ownership or custody of goods
2. Does not guarantee product quality or fitness
3. Shall not be liable for any defects, adulteration, expiry, or regulatory violations by stores
4. All claims relating to goods shall lie against the concerned store, though Buy Buy Cart may assist in coordination without assuming liability.

1. Partial Deliveries and Split Shipments

Orders may be delivered in multiple parts due to sourcing from different stores or warehouses. Partial delivery does not entitle cancellation or compensation unless expressly agreed in writing.

1. Bulk, Institutional, and B2B Orders

Bulk or institutional orders are subject to customized delivery schedules, loading/unloading responsibilities, and acceptance protocols as agreed separately in writing.

1. Force Majeure

Buy Buy Cart shall not be liable for delivery delays or failures caused by events beyond reasonable control, including natural disasters, strikes, governmental actions, transport disruptions, or regulatory restrictions.

1. Refusal and Non-Acceptance

Delivery may be refused in cases of unsafe locations, abusive conduct, non-payment, or legal restrictions. Unjustified refusal may result in cancellation and recovery of costs.

1. Transfer of Risk and Title

Risk and title in goods pass to the customer upon successful delivery at the designated location.

1. Amendments to Policy

Buy Buy Cart reserves the right to amend this Shipping and Delivery Policy at any time. The policy in force at the time of order placement shall apply.
